Job Description

We have an exciting opportunity for a Senior Legal Counsel (m/f/d) to further strengthen the German Legal Department and to advise Gilead Germany on a broad range of legal matters. As a Senior Legal Counsel you will assume an important role within the German Legal Department reporting to the Head of Legal and Business Conduct Germany. You will be responsible for advising and managing the legal topics of a business franchise and other departments, providing guidance, direction and possible solutions to all franchise related activities in an international context. You are a strong individual contributor with a reliable judgement, substantial knowledge of the relevant areas of law and business. You will apply your strong project management, communication and interpersonal skills both in a national and international environment. The role will play an integral part in the further development of the Legal/Business Conduct team, working as well to ensure compliance with all applicable healthcare laws, regulations and codes of practice. The Senior Legal Counsel will also work and liaise with colleagues in the international and global legal function. The duties and job functions of this role include the activities set out below related to the effective running of the German Affiliate Legal and Business Conduct function.

The Senior Legal Counsel will be based in the German office in Martinsried near Munich (Germany).

Specific Role

The Senior Legal Counsel will advise one of the affiliate’s business franchises and other departments on all legal topics across all potential legal areas including but not limited to contract law, pharmaceutical law, advertising in the health care sector, unfair competition, compliance and business conduct, data privacy law, clinical research contracts and litigation.

The Senior Legal Counsel will be responsible for providing all kinds of legal services required to fully support and counsel the company’s business in Germany as well as managing and supervising outside counsel where necessary.

The Senior Legal Counsel works collaboratively with other members of the Global or International Legal department as well as internal client departments. She/he sets appropriate priorities with clients and delivers results within established timelines and contributes to multidisciplinary and/or international projects, implements / supports legal oriented projects, and takes responsibility for legal aspects of projects. The Senior Legal Counsel

  • serves as member of the German team as a strategic resource representing the legal function
  • acts as strong and true business partner to the Head of Legal, the General Manager, the local senior management team and internal clients (Commercial, Medical, Regulatory, Distribution, etc.) having in-depth understanding of the company products and the market environment and corresponding business processes to identify any opportunity to drive business forward and raise the knowledge of the business
  • independently develops templates for the business franchise and drafts tailored contracts where necessary
  • is responsible for analyzing and determining legal risks associated with Gilead’s business
  • ensures alignment with Global and International strategy when structuring and negotiating contracts or providing advice to internal clients
  • advises on and approves promotional and non-promotional materials and internal / external events organized or supported by Gilead
  • trains employees on legal topics, e.g. trainings on pharmaceutical law, anticorruption, business conduct, compliance codices, competition & antitrust law and dawn raids

Knowledge, Experience & Skills:

The ideal candidate is a highly motivated pro-active self-starter with a pragmatic can-do attitude and a high dedication and natural interest to legal topics in life-science industry. Specific experience in the following areas is very advantageous: pharmaceutical law, law on advertising in the health care sector, reimbursement of medicines, contract law, competition law, business and corporate law, intellectual property law, data protection laws and employment law.

Typical Education & Experience

  • Fully qualified lawyer (German State Examination 1st/2nd).
  • In-depth understanding of business objectives and how those translate into legal’s priorities to deliver practical advice and guidance to the business.
  • Multiple years of industry or law firm experience.
  • Experience in pharmaceuticals/biotech industry required.
  • Must be fluent in English and in German.
  • Experience in drafting, negotiating and implementing a wide range of commercial agreements including those related to distributor and logistics management, access to medicines initiatives, collaborations, coalitions service provision, and other significant strategic agreements.
  • Exercising judgement and determining and taking appropriate action where precedent may not exist.
  • Able to engage with and manage workstreams with external counsel.
  • Excellent interpersonal and influencing skills, an inquisitive mind, and the ability to work effectively in a global, matrixed organisation with multiple functions, together with a positive attitude and strong work ethic.
  • Ability to quickly establish credibility with diverse audiences. Consistently retains a sense of the ‘bigger picture’.
