Summary of the position:

Provides legal counsel to assigned functions or departments within the assigned business franchise. This role will deliver specialist legal advice and support to senior management and other business colleagues on a variety of commercial and regulatory matters (e.g., pricing and reimbursement of medical devices, sales agreements, healthcare fraud and abuse, distribution arrangements, antitrust, marketing and advertising promotional practices, data privacy, dispute resolution and general creditor issues).

Main tasks of the position

  • Primarily provide advice and counsel on commercial and business law issues to all functional groups within the company including franchise management, marketing, sales, finance, credit, medical & scientific, product commercialization, and partnering.

  • Develop an in-depth working knowledge of the products, pipeline, market and business model and apply this knowledge in the delivery of sound and practical legal advice.

  • Support the company’s compliance program ensuring compliance with laws, regulations, and industry standards that include, among others, state and federal anti-kickback statutes, compliance with laws impacting CLIA labs and IDTFs, distribution arrangements, pharmacy retail arrangements, trademark and copyright laws, compliance with FDA and other relevant regulatory requirements, and compliance with company policies, procedures, and code of conduct.

  • Foster cross-functional and business unit collaboration across company’s product portfolio and affiliated entities.

  • Work as a liaison between in-house clients and in-house subject matter expert attorneys (intellectual property, regulatory, fraud and abuse, labor & employment) to ensure effective mitigation of risk in specialized areas of law.

  • Draft, review, and negotiate a wide range of commercial agreements and other legal documents.

  • Work with global company affiliate business partners and affiliate attorneys as necessary to assist company in achieving business goals.

  • Help set priorities for the Legal department and actively engage as a lawyer and leader within the Legal department.

Qualifications of the position:

  • Education: Doctor of Jurisprudence from an ABA-accredited law school, licensed to practice law in one or more of the 50 states.

  • Professional experience/duration: At least 5-8 years’ experience practicing law at a large- to medium-sized law firm or within a corporate law department; practice should include areas of specialization, preferably in life sciences (pharma, diagnostics, device, biotech).

  • Specialist knowledge:

    • Must have strong leadership skills to inspire, empower, and develop legal professionals with a desire to coach and develop the team.

    • Knowledge of healthcare and life sciences industries and relevant laws and regulations (Anti-Kickback Statute, False Claims Act, FDCA, HIPAA, FTC, etc.) strongly preferred.

    • Strong transactional, contract development and negotiation experience.

    • Demonstrated ability to establish and maintain open, candid and trusting work relationships.

    • Excellent analytical, problem solving skills, and the ability to manage ambiguous situations and issues.

    • Willingness and ability to deliver a consistent message in the face of pressure or adversity.

    • Ability to encourage transparent and connected culture between the Legal department and business stakeholders.

    • A demonstrated ability to establish and maintain open, candid and trusting work relationships.

You are also responsible for building, and then providing effective legal guidance and support for Roche Diagnostics. Doing so in a manner that is consistent with the Roche Values and leadership capabilities. You will seek to inspire and lead the legal and compliance team to create transformative solutions, and to influence their prioritization and uptake in the wider organization, in order to ensure that customer solutions are at the forefront and that the legal and compliance department delivers its optimal contribution to the Roche Diagnostics Vision.

Relocation benefits are not available for this posting.

The expected salary range for this position based on the primary location of Indiana is $130,200 to 241,800. Actual pay will be determined based on experience, qualifications, geographic location, and other job-related factors permitted by law. A discretionary annual bonus may be available based on individual and Company performance. This position also qualifies for the benefits detailed at the link provided below.
